GST Annual Return

Annual return is a return form in format GSTR-9 is to be filed by taxpayers registered under GST. It contains details of all outward supplies made, Input tax credit availed on inward supplies received during the relevant previous year on Inputs, capital goods and input services under different tax heads i.e. CGST, SGST & IGST, Reconciliation of 2A and ITC claimed, HSN wise summary of outward and inward supplies, along with details of taxes payable and paid.

It is a consolidated summary form of all the monthly or quarterly returns (GSTR-1, GSTR-2A, GSTR-3B or GSTR-4) filed during that year. 

Ques. Who all are required to file GSTR-9 Annual return?

Ans. All taxpayers/taxable persons registered under GST must file their GSTR 9. However, the following persons are NOT required to file GSTR 9:

  • Taxpayers registered under composition scheme (They are required to file GSTR-9A)
  • Casual Taxable Person
  • Input service distributors
  • Non-resident taxable persons
  • Persons paying TDS in GST Act.
 

Ques. What are the different types of GST Annual return required to be filed?

Ans. Following are the Different kinds of annual return required to be filed under GST act:

  • GSTR-9 Annual Return Form: The regular taxpayer who are filing GSTR-1 and GSTR-3B forms are required to file the GSTR-9.
  • GSTR-9A: Taxpayers registered under composition scheme under GST is required to file GSTR-9A.
  • GSTR-9B: E-commerce operators who are filing GSTR-8 are required to file GSTR-9B.
 

Ques. What is the due date of filing GST Annual return (GSTR-9) for a financial year?

Ans. The GSTR-9 due date for filing is before the 31st December of the following year. (For example: If you are filing the GSTR-9 for 2019-2020 then the due date to file it is before the 31st of December 2020.)

Ques. What is the penalty/late fees if GST Annual return is filed after due date?

Ans. The Penalty for Annual returns if it is not filed after due date is:

  • Notice u/s 46 for filing of GSTR 9 can be ordered by the authorities (within 15 days of such notice is to be filed).
  • General penalty as mentioned under section 125, of the CGST Act up to Rs 25,000/- can be levied by proper office (P.O)
 

The Late fees for Annual return if it is not filed up to due date is:

  • The late fees for not filing the GSTR 9 within the due date are Rs 100 per day, per act. This means late fees of Rs 100 under CGST act and Rs 100 under SGST act will be applicable in case of delay. Thus, the total liability is Rs 200 per day of default.
  • But this is subject to a maximum cap of 0.25% of the taxpayer’s turnover in the relevant state or union territory. However, there is no late fee on IGST yet.
 

Ques. From where we can find GSTR-9 offline excel tool?

Ans. Anyone can download GSTR-9 annual return offline excel tool for Government website https://www.gst.gov.in/download, but there are some system requirements which are to be adhered to run this tool i.e:

To use the tool efficiently, ensure that you have the following configuration installed on your computer system:

  1. Operating system Windows 7 or above.
  2. Microsoft Excel 2007 & above
 

Ques. What is the structure of GSTR-9 annual return?

Ans. Annual Return format as notified in the form GSTR-9 is a very exhaustive document wherein the transactions pertaining to the last years have to be reported. It is divided into 5 parts as below:

Part I: Basic Details like-GSTIN, Financial year, etc.

Part II: Details of outward supplies (B2B, B2C, Zero rated, etc) as reported in returns during the financial year to be mentioned on which tax is payable (Table-4) & on which tax is not payable (Table-5)

Part III: Details of ITC availed and reversed, declared in the GSTR-3B Returns filed during the Financial Year with segregation into Input, Input Services and capital goods.

Part IV: Details of taxes paid through cash or set off through ITC, as declared in returns filed during the financial year.

Part V: Particulars of the transactions for the previous FY declared in returns of April to September of current FY or up to date of filing of annual return of previous FY whichever is earlier (Table 10 to 14)
